Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Topcoat voice-to-quote service (the "Service") provided by Topcoat ("Topcoat", "we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Topcoat lets painting professionals ("Painters") create price quotes by voice and send those quotes to their customers ("Homeowners") by text message and web link.

Painters use Topcoat to record job details, generate an itemized quote, and send it to a Homeowner who has requested one.
Homeowners receive a quote by SMS only after providing their phone number and consenting to be contacted.

2. SMS / Text Messaging Program

Program name: Topcoat. Program description: Topcoat delivers painting quotes from Painters to Homeowners who have requested them, along with related transactional follow-ups.

Message types & frequency: Messages are transactional and low-volume — typically about one message per quote. Message frequency varies.

Msg & data rates may apply.

Reply STOP to any message to opt out and stop receiving texts. Reply HELP for help, or contact us using the details below.

Carriers are not liable for delayed or undelivered messages. Supported carriers may change, and message delivery is subject to carrier and device availability.

3. Acceptable Use (Painters)

If you are a Painter, you are solely responsible for your use of the Service and for the messages sent on your behalf. In particular, you agree that:

You will only send a consent link or quote to a Homeowner with whom you have a genuine service relationship and who has requested or agreed to receive it.
You will not use the Service to send marketing, promotional, or unsolicited messages.
You will provide accurate information and comply with all applicable laws, including those governing text messaging and consumer protection.

4. Quotes Are Estimates

Quotes generated through the Service are non-binding estimates prepared by the Painter. Topcoat does not set prices, perform painting work, or guarantee the accuracy of any quote. Any agreement for painting services is solely between the Painter and the Homeowner.

5. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

6. Limitation of Liability

To the fullest extent permitted by law, Topcoat and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or $100.

7. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction and venue there.

8. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
